Effective August 17, 2026. These Terms govern your use of carlamcherry.com and purchases from Sweet as a Simile LLC.

1. About these Terms

Carla M. Cherry’s website and online store at carlamcherry.com (the “Site”) are operated by Sweet as a Simile LLC, located in Bronx, New York 10475 (“Sweet as a Simile,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) apply to your access to the Site and to orders placed directly through it.

By using the Site or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site. Nothing in these Terms limits rights that cannot lawfully be waived under applicable consumer-protection law.

2. Eligibility and customer responsibilities

You must be at least 18 years old, the age of legal majority where you live, or acting with the permission and supervision of a parent or legal guardian to place an order. You agree to provide current, complete, and accurate contact, billing, shipping, and payment information.

You are responsible for reviewing your order, product selection, size, color, delivery address, and contact information before completing checkout. You may not use the Site for an unlawful purpose, interfere with its security or operation, impersonate another person, or use automated tools to scrape, copy, or disrupt the Site.

3. Products, descriptions, and availability

We sell books, apparel, accessories, and other creative merchandise. Many merchandise items are made to order. We try to display product descriptions, dimensions, colors, artwork placement, and images accurately, but screen settings, manufacturing methods, garment variations, and production batches may cause reasonable differences in appearance, color, size, or placement.

Products, variants, prices, promotions, and availability may change without notice. We may correct typographical, pricing, or inventory errors and may refuse or cancel an affected order. If we cancel an order after payment, we will refund the amount charged for the cancelled item or order.

Some books, media, or other items may be offered through an independent bookseller, publisher, marketplace, or other third-party site. A purchase completed on a third-party site is governed by that seller’s terms, privacy policy, shipping practices, and return policy, not these Terms.

4. Orders, prices, payments, and taxes

Prices are shown in U.S. dollars unless stated otherwise. Available shipping charges, discounts, and estimated taxes are displayed during checkout. Orders placed through the Site are currently available for delivery to addresses in the United States.

Payments are processed securely by Stripe. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charge. We do not store your full payment-card number on the Site.

An order confirmation only acknowledges that we received your order. We may review, accept, reject, or cancel an order for reasons such as payment failure, suspected fraud, an unavailable product, an invalid address, or an obvious pricing error. Promotional offers may have separate restrictions and may not be combined unless stated otherwise.

5. Made-to-order production and fulfillment

Our made-to-order merchandise is produced and fulfilled by Printful after payment is confirmed. Because production may begin automatically, changes or cancellations may not be possible once an order enters fulfillment. Contact us immediately if you discover a mistake; we will try to help, but we cannot guarantee a change or cancellation after production begins.

Printful and shipping carriers receive the information reasonably needed to produce, ship, track, and support your order. They act under their own service terms and privacy practices.

6. Shipping and delivery

Production and delivery dates shown at checkout or in messages are estimates, not guarantees, unless we expressly state otherwise. Delivery may be affected by product availability, order volume, carrier operations, weather, holidays, address problems, customs, or events outside our reasonable control.

You are responsible for providing a complete and deliverable address. If a shipment is returned because the address was incorrect or incomplete, or because the package was unclaimed, you may be responsible for the cost of reshipping it, to the extent permitted by law.

If we learn that we cannot ship within the time promised—or, when no time was promised, within the period required by law—we will provide an appropriate delay notice and an opportunity to consent to the delay or cancel for a prompt refund, as applicable.

7. Returns, replacements, and refunds

Because made-to-order merchandise is produced specifically for each order, we generally do not accept returns or exchanges for buyer’s remorse, a change of preference, or selection of the wrong size or color, except where required by law. Please review the product description and available size guide before ordering.

If an item arrives damaged, defective, misprinted, or materially different from what you ordered, contact us within 30 days after delivery. Include your order number, a description of the problem, and clear photographs of the item and packaging. For a shipment believed lost in transit, contact us within 30 days after the estimated delivery date.

Do not mail an item back without receiving instructions from us. If a claim is approved, we may provide a replacement, refund, or other appropriate remedy. Approved refunds are normally returned to the original payment method. These procedures do not limit any nonwaivable rights or remedies available under applicable law.

8. Intellectual property

The Site and its literary works, poetry, artwork, photographs, product designs, graphics, logos, names, text, video, audio, and other content are owned by or licensed to Sweet as a Simile LLC and are protected by intellectual-property laws. You may access the Site for personal, noncommercial use only.

Unless we give prior written permission, you may not reproduce, distribute, modify, publish, sell, commercially exploit, scrape, systematically extract, or create derivative works from Site content. Purchasing a product does not transfer any copyright, trademark, publicity, or other intellectual-property right in its design or content.

9. Third-party services and links

The Site uses third-party services, including Stripe for payment processing and Printful for production and fulfillment, and may link to social media, video platforms, booksellers, publishers, or marketplaces. We are not responsible for the availability, content, security, products, or practices of independent third parties. Your use of a third-party service is subject to that provider’s terms and privacy policy.

10. Disclaimers and limitation of liability

The Site and its content are provided on an “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties that may lawfully be disclaimed. We do not warrant that the Site will always be uninterrupted, error-free, or free of harmful components. Literary, educational, artistic, and general informational content on the Site is not professional legal, medical, financial, or other professional advice.

To the fullest extent permitted by law, Sweet as a Simile LLC and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site. For a claim relating to a particular order, our aggregate liability will not exceed the amount you paid for the affected order. These limitations do not apply where prohibited by law, including liability that cannot legally be excluded.

11. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights that apply where you live, disputes relating to these Terms or the Site will be brought in the state or federal courts serving Bronx County, New York, and you consent to their jurisdiction.

Before filing a formal claim, we encourage you to contact us so we can try to resolve the concern promptly. This section does not prevent either party from seeking relief in small-claims court when eligible or exercising a right that cannot be waived.

12. Changes, severability, and waiver

We may update these Terms to reflect changes in the Site, our products, our business practices, or the law. The revised Terms will be posted here with a new effective date, and we will provide additional notice when required. Changes apply prospectively unless the law permits otherwise.

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A delay or failure to enforce a provision is not a waiver of the right to enforce it later.
